German1. Scope of Application
These General Terms and Conditions (GTC) apply to all orders placed through our online shop.
2. Contract Partner, Conclusion of Contract
The purchase agreement is concluded with UHREN-FAN.
The presentation of products in our online shop does not constitute a legally binding offer, but rather a non-binding online catalog. You may initially add our products to your shopping cart without any obligation and correct your entries at any time before submitting your binding order by using the correction aids provided and explained during the ordering process. By clicking the order button, you place a binding order for the goods in the shopping cart. We will immediately send an email to confirm receipt of your order after you submit it, but this confirmation does not constitute acceptance of your contract. We may accept your order by sending an acceptance declaration in a separate email or by delivering the goods within two days.
A binding contract can also come into effect beforehand as follows:
If you have chosen the payment method PayPal, the contract is concluded at the time you confirm the payment instruction to PayPal.
The languages available for the conclusion of the contract are German and English.
We do not store the text of the contract.
3. Delivery Conditions
In addition to the product prices indicated, shipping costs are added. You can find out more about the shipping costs in the offers.
You generally have the option to pick up your order at UHREN-FAN, Maxim-Gorki-Strasse 19, 39108 Magdeburg, Germany during the following business hours: 09:00 AM – 05:00 PM.
We do not deliver to pack stations.
4. Payment
The following payment methods are available in our shop:
Advance payment
When selecting the advance payment method, we will provide you with our bank details in the order confirmation and deliver the goods after receipt of payment.
Cash on delivery
When selecting cash on delivery, there are additional costs of 20 euros.
PayPal
You pay the invoice amount through the online provider PayPal. You must generally be registered with them or register first, validate your access data and confirm the payment instruction to us. You will receive further instructions during the order process.
For selecting the payment method PayPal/PayPal Express, additional costs of 5 percent of the purchase price are due.
Cash payment upon collection
You can pay cash for your goods upon collection.
5. Reservation of Title
The goods remain our property until full payment is made.
6. Transport Damages
If goods are delivered with apparent transport damage, please claim such defects as soon as possible with the delivery agent and please contact us immediately. The failure to file a complaint or contact us has no consequences for your statutory claims and their enforcement, especially your warranty rights. However, you help us to assert our own claims against the carrier or transport insurance.
7. Warranty and Guarantees
Unless expressly agreed otherwise below, the statutory warranty for defects applies.
The limitation period for claims for defects in used items is one year from the delivery of the goods.
The aforementioned limitations and reduction in periods do not apply to claims for damages caused by us, our legal representatives or vicarious agents
in case of injury to life, body, or health
in case of intentional or grossly negligent breach of duty as well as malice
in case of breach of essential contractual obligations, the fulfillment of which enables the proper execution of the contract in the first place and on which the contractual partner may regularly rely (cardinal obligations)
within the scope of a guarantee promise, if agreed
as far as the area of application of the Product Liability Act is opened.

8. Liability
For claims based on damages caused by us, our legal representatives or vicarious agents, we are always liable without limitation
in case of injury to life, body, or health
in case of intentional or grossly negligent breach of duty
in case of warranty promises, as far as agreed

In case of breach of essential contractual obligations, which are necessary for the proper execution of the contract and on which the contractual partner may regularly rely, through negligence by us, our legal representatives, or vicarious agents, liability is limited in amount to the foreseeable damage at the time of the conclusion of the contract, which must typically be expected.
Otherwise, claims for damages are excluded.
9. Online Dispute Resolution
Online dispute resolution according to Art. 14 (1) ODR Regulation: The European Commission provides a platform for online dispute resolution (OS), which you can find at https://ec.europa.eu/consumers/odr/.
Instructions on Cancellation
Consumers have a fourteen-day right to cancel.
Right to Cancel
You have the right to cancel this contract within fourteen days without giving any reason.
The cancellation period is fourteen days from the day on which you, or a third party named by you who is not the carrier, took possession of the last goods.
To exercise your right of cancellation, you must inform us (Mario Gensicke, Westring, 6, 39110 Magdeburg, shop@uhren-fan.de, Phone: +4939140591143, Fax: +4939140591144) by means of a clear statement (e.g., a letter sent by post, fax, or email) about your decision to cancel this contract. You can use the attached model cancellation form, which is not mandatory.
To meet the cancellation deadline, it is sufficient to send the communication concerning the exercise of the right of cancellation before the cancellation period has expired.
Effects of Cancellation
If you cancel this contract, we must reimburse you for all payments we have received from you, including the delivery costs (except for additional costs resulting from your choice of a type of delivery other than the least expensive standard delivery offered by us), without delay and at the latest within fourteen days from the day on which we received the notice of your cancellation of this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees for this repayment. We may refuse repayment until we have received the goods back or until you have provided evidence that you have returned the goods, whichever is earlier.
You must return or hand over the goods to us immediately and in any event, not later than fourteen days from the day on which you inform us of the cancellation of this contract. The deadline is met if you send the goods before the expiration of the fourteen-day period. You will bear the direct cost of returning the goods amounting to 50 EUR. You will only have to pay for any diminished value of the goods if this loss in value is due to handling that is not necessary for checking the quality, characteristics, and functioning of the goods.
